The only tough part is the "free speech" thing. It's going to be hard for the courts to have exceptions to that rule. (Like why don't they include the Spam at your regular mailbox, for example?)
But I know for a fact that ISPs are behind this in a big way. It's their servers that get bogged down with this useless traffic, and their customers who complain and even cancel accounts with them to be rid of it.
Thank goodness the law is starting to clamp down on this crap!
